Complaints and returns

Right to withdraw from the contract

7.1. The customer who is a consumer within the meaning of art. 221 of the Civil Code, has the right - under the law - to withdraw from a distance contract, without giving any reason, by submitting a relevant statement in writing, within 14 days and sending it to the address provided in these regulations, bynature.ie
7.2. The 14-day period is counted from the day on which the Goods were delivered.
7.3. The consumer's right to withdraw from the contract is excluded in the case of:
"made-to-order" goods with properties specified by the consumer in the order placed by him or closely related to his person;
7.4. In the event of withdrawal from a distance contract, the contract is considered not concluded. What the parties have provided is returned unchanged, unless the change was necessary within the scope of ordinary management. The return should be made immediately, no later than within 14 days. 7.5. The Goods returned by the Customer should be packed in an appropriate way (preferably as it was sent, if possible in the same packaging) ensuring no damage to the shipment during transport.
7.6. The cost of packaging and returning the goods is borne by the customer.

Complaints about Goods

8.1.bynature.ie as a seller is liable to the Customer who is a consumer within the meaning of art. 221 of the Civil Code, for non-compliance with the Sales Agreement of the Goods purchased by this consumer, to the extent specified in the Act on specific conditions of consumer sales.
8.2. Complaints arising from the violation of the Customer's rights guaranteed by law or under these Regulations should be addressed to shop@bynature.ie. Bynature.ie undertakes to consider each complaint within 14 days, and if this was not possible, to inform the Customer within this period when the complaint will be considered.
8.3.Bynature.ie is not a producer of goods. The manufacturer is liable under the warranty for the sold Goods on the terms and for the period indicated in the warranty card. If the warranty document provides for such a possibility, the customer may submit his claims under the warranty directly to the authorized service whose address is included in the warranty card.

Complaints regarding the provision of electronic services

9.1. Bynature.ie takes steps to ensure the fully correct operation of the Store, to the extent that results from current technical knowledge, and undertakes to remove any irregularities reported by Customers within a reasonable time.
9.2. The customer is obliged to immediately notify bynature.ie of any irregularities or interruptions in the functioning of the Online Store website.
9.3. Irregularities related to the functioning of the Store may be reported by the Customer in writing to the following address: by e-mail to the following address artur.aptiphy@gmail.com  or using the contact form.
9.4. In the complaint, the Customer should provide his name and surname, correspondence address, type and date of irregularities related to the functioning of the Store.
9.5. bynature.ie undertakes to consider each complaint within 14 days, and if this was not possible, to inform the Customer within this period when the complaint will be considered.

Final Provisions

10.1. Settlement of any disputes arising between bynature.ie and the Customer who is a consumer within the meaning of art. 221 of the Civil Code, shall be submitted to the competent courts in accordance with the provisions of the relevant provisions of the Code of Civil Procedure.
10.2. Settlement of any disputes arising between bynature.ie and the Customer who is not a consumer within the meaning of art. 221 of the Civil Code of the Civil Code, is subject to the court competent for the seat of bynature.ie
10.3. In matters not covered by these Regulations, the provisions of the Civil Code, the provisions of the Act on the provision of electronic services and other relevant provisions of Irish law shall apply.

Withdrawal from the contract

1.1. The Ordering Party has the right to withdraw from the contract upon receipt of the Ordered Goods from the supplier. The Ordering Party is then obliged to proceed as in the case specified in Chapter I above (point 3.2). and completing the Return Protocol referred to in the aforementioned point. The returned Goods must have undamaged, original manufacturer's packaging, should be complete and must not bear traces of use.

1.2. In the event of withdrawal from the contract, pursuant to point 1.1. above, both the Seller and the Ordering Party are obliged to return everything they received from the other party under the concluded contract. If the payment for the order has been collected in advance, the Seller will return the purchase price to the Ordering Party no later than 14 days from the return of the Goods.
 
2. If the Seller finds violations in the form of traces of use, damage or destruction of the original packaging, in particular the packaging of the Goods, the declaration of withdrawal will be considered ineffective and the Goods will not be returned.

Complaint

1. The following forms of submitting complaints about Goods and procedures for their consideration are available in the Store:

a. at the time of receipt of the Order from the Supplier, when checking the compliance of the delivery with the content of the order.

b. The signing of the Return Protocol by the Ordering Party and the Supplier, containing the statement of the lack of Goods or the defectiveness of the Goods included in the Order, is tantamount to lodging a complaint by the Ordering Party. In this case, the complaint is considered upon receipt of the Order.

If the complaint is accepted, the Seller will replace the Goods with full-fledged Goods or, if it is impossible (for example, due to the depletion of stock), the Seller will offer a choice of other Goods available in the Store or reduce the amount of payment for the Goods accordingly.

If the complaint is accepted, in the case of collecting the Order from the Supplier, when paying on delivery, the Ordering Party shall pay the amount reduced by the amount resulting from the lack or defectiveness of the received Goods.

If the complaint is accepted, with the payment collected in advance, the Seller will return to the Ordering Party the amount corresponding to the price of the goods complained about, no later than 14 days from the moment of recognizing the complaint as justified.

2. In each case, the basis for considering the complaint is a receipt containing the product under complaint or a VAT invoice.
 
3. The delivery of the Goods not ordered by the Ordering Party is at the Seller's risk and does not impose any obligations on the Ordering Party.
